WHAT THE LAW AND NATIONAL CREDIT ACT SAYS ABOUT PDAS – AND HOW CONSUMERS ARE PROTECTED

In South Africa, Payment Distribution Agencies (PDAs), like DC PARTNER PDA  (ABOUT US)  play a critical role in the debt review process by acting as intermediaries between consumers and their creditors. Their work is governed by the National Credit Act (NCA), which ensures that consumers are treated fairly and protected from exploitation.

What is a PDA?

Under the National Credit Act, PDAs must be registered and regulated by the National Credit Regulator (NCR). The NCA sets out several key requirements for PDAs:

How Consumers Are Protected:


The NCA provides multiple layers of protection for consumers making use of PDAs:

1. Transparency
Consumers must receive regular statements showing how their payments are distributed. This ensures they always know where their money is going.

2. Accountability and Oversight
The NCR monitors PDAs through regular audits and monthly reporting.

3. Protection of Funds
PDAs are required to keep consumer funds in separate Section 44A trust accounts, reducing the risk of misappropriation.

4. Fair Distribution of Payments
Payments are distributed according to an approved repayment plan issued by the Debt Counsellor, ensuring that all creditors are treated fairly and that the consumer’s debt review process stays on track.

5. Complaint Mechanisms
Consumers have the right to lodge complaints with the NCR if they have concerns that cannot be resolved.

Why it is beneficial to use a PDA:

It is beneficial for a Consumer to use a PDA, as it gives them peace of mind that payments will be collected with minimal effort on their end and it is followed by timely and accurate distributions. It takes the administrative effort- and pressure off the Consumers’ shoulders.
